Frustratingly for all concerned, there exists a widely held misconception regarding a requirement for Security Industry Authority<\/strong>, ACS<\/strong> approval.<\/p>\n\n\n\n

It is absolutely correct that no ACS <\/strong>approved company is able to subcontract security services to a non ACS <\/strong>approved company unless special permission is granted from the SIA<\/strong>.<\/p>\n\n\n\n

Understanding SIA Regulations<\/h2>\n\n\n\n

Importantly however, the SIA<\/strong> clearly states that staff agencies, and companies that only provide Security Officers, are not deemed as providing any 3rd party security service, and therefore ACS approved companies<\/strong> are completely free to use their services, regardless of whether the labour provider is ACS<\/strong> approved or not, completely without restriction.<\/p>\n\n\n\n

For absolute clarity, the Security industry Authority\u2019s \u201cGuidance for Approved Contractors 019\u201d document, states:<\/strong><\/p>\n\n\n\n

\u201cNote: <\/strong>The term \u2018subcontractor\u2019 in this guidance <\/em>does not apply to staff obtained through an agency<\/em><\/strong>. Approved contractors can only subcontract provision of a security service (for which they are approved) to other approved contractors, unless an exemption from subcontracting requirements has been applied for an agreed by us. <\/em>This does not apply in cases where a subcontractor solely supplies labour \u2013 \u2018subcontracted labour\u2019. Such organisations are not required to be approved and may in some cases not be eligible for ACS.<\/em><\/strong> This exception covers self-employed individuals and \u2018agencies\u2019 supplying temporary staff whose licensable activities are under the supervision, direction or control of the approved contractor. This may include another security provider, a labour provider, or employment business\u2026\u2026..\u201d<\/em><\/p>\n\n\n\n

So there you have it.<\/p>\n\n\n\n
