Terms and Conditions of Use for GuardPass and GuardCheck
These terms and conditions ("Terms") govern your use of GuardPass by Get Licensed (referred to as the "Job Board") and the services provided through the Job Board, as well as the services offered by GuardCheck. By accessing or using the Job Board and/or GuardCheck services, you agree to comply with these Terms. If you do not agree with these Terms, please refrain from using the Job Board and GuardCheck services. GuardPass and GuardCheck reserve the right to update these Terms periodically. It is your responsibility to review the updated Terms regularly, and it is suggested that you check these Terms each time you wish to use the Job Board or GuardCheck services. Continued use of the services constitutes your acceptance of any modifications.
1.1 "Job Board" refers to the platform, GuardPass, where job listings are posted and candidates connect with potential employers.
1.2 "GuardCheck"fers to the background screening and vetting services operated by GuardPass, designed to assist employers in making informed hiring decisions. GuardCheck is a sub-service of GuardPass and is wholly owned and managed by GuardPass.
1.3 "User" refers to any individual or entity accessing the Job Board or GuardCheck services, including job seekers, employers, and clients.
1.4 "Client" refers to businesses or individuals engaging GuardCheck for screening and vetting services. Clients are considered the data controllers under data protection laws.
1.5 "Report" refers to the vetting summary and supporting documentation prepared by GuardCheck for each candidate screened under the BS7858 standard.
2.1 By using the Job Board and/or GuardCheck services, you agree to:
- Provide accurate, truthful, and complete information when creating an account, submitting job listings, or requesting screening services.
- Promptly update your information to maintain accuracy.
2.2 You shall comply with all applicable laws and regulations when using the Job Board and GuardCheck services, including but not limited to:
- Employment laws.
- Anti-discrimination laws.
- Data protection laws.
- Intellectual property laws.
2.3 You agree to adhere to the guidelines, policies, and instructions provided by GuardPass and GuardCheck, including:
- Content submission guidelines.
- Usage restrictions.
- Community guidelines.
2.4 You are responsible for safeguarding your account credentials and for all activities conducted under your account. GuardPass and GuardCheck are not liable for unauthorised access resulting from your failure to protect your credentials.
2.5 Prohibited Uses: You shall not:
- Post false or misleading information.
- Engage in fraudulent activities.
- Attempt to disrupt or hack the platform.
- Violate the privacy rights of others.
3.1 The Job Board, GuardCheck services, and their content (including text, graphics, logos, and software) are protected by intellectual property laws and are the property of GuardPass, GuardCheck, or their licensors.
3.2 Users are prohibited from using, copying, distributing, or reproducing any content from the Job Board or GuardCheck services without explicit authorisation from GuardPass or the respective rights holders.
3.3 By submitting content to the Job Board, you grant GuardPass a non-exclusive, worldwide licence to use, reproduce, distribute, and display the content for the purposes of operating and promoting the platform.
4.1 Users are solely responsible for the accuracy, legality, and integrity of the information provided in job listings.
4.2 Job listings must comply with all applicable laws, including:
- The Employment Rights Act 1996.
- The Equality Act 2010.
- Other relevant legislation.
4.3 Discriminatory, offensive, or misleading job listings are strictly prohibited. GuardPass reserves the right to review, modify, or remove job listings and content without prior notice or liability.
4.4 GuardPass does not endorse or guarantee the accuracy, quality, or suitability of any job listings or content posted on the Job Board. Users are responsible for conducting their own due diligence and making informed decisions.
4.5 GuardPass reserves the right to suspend accounts in cases of suspected misuse and may modify or withdraw any offers at any time without prior notice.
5.1 GuardPass and GuardCheck are committed to compliance with:
- The UK General Data Protection Regulation (GDPR).
- The Data Protection Act 2018.
5.2 Personal data will be processed lawfully, fairly, and transparently, and collected only for specified, explicit, and legitimate purposes.
5.3 Users retain the right to:
- Access their data.
- Correct inaccuracies.
- Request deletion of their data.

6.1 Scope of Services: GuardCheck provides background screening and vetting services in accordance with BS7858:2019 standards, including but not limited to:
- Identity verification.
- Employment history checks.
- Criminal record checks.
- Financial status checks.
6.2 Compliance & Standards: GuardCheck aims to operate in full accordance with NSI Code of Practice NCP 119 – Provision of Labour in the Security and Events Sector. However, GuardCheck provides screening services only and does not supply security officers or physical labour to clients.
6.3 Subcontractor Position: Clients understand that GuardCheck acts solely as a subcontracted provider of vetting documentation. GuardCheck does not employ or deploy candidates and is not responsible for ensuring final suitability or licensing.
6.4 Client Responsibilities: GuardCheck strives for accuracy but shall not be held liable for errors in third-party data or reporting delays.
- Clients are responsible for final employment decisions, right-to-work verification, SIA licensing, and all obligations under UK employment and security laws.
- Clients shall use the screening information responsibly and maintain their own compliance with the Private Security Industry Act 2001 and related guidance.
6.5 Confidentiality: GuardCheck will handle all personal data obtained during the screening process in accordance with GDPR and other applicable data protection laws. Data is transmitted through secure, encrypted channels and stored in compliance with NSI audit expectations.
6.6 Reporting and Use: GuardCheck provides completed screening reports and supporting documents for client review. The client acknowledges full liability for interpretation and use of these reports in hiring decisions.
6.7 Limitations of Liability: GuardCheck strives for accuracy but shall not be held liable for:
- Errors or omissions in third-party data.
- Delays due to incomplete or delayed candidate documentation.
- The conduct or actions of any candidate screened.
6.8 Data Retention and Deletion: GuardCheck strives for accuracy but shall not be held liable for:
- Candidate data is retained for 60 days after final report delivery.
- After this period, all candidate records are securely deleted.
- Clients may not request deletion before this retention period ends unless legally justified.
7.1 User Indemnity: Users agree to indemnify and hold harmless GuardPass and GuardCheck from any claims, liabilities, losses, or damages arising from:
- Misuse of services.
- Breach of these Terms.
- Violation of applicable laws.
7.2 GuardPass Indemnity: GuardPass is not liable for the suitability, conduct, or legal compliance of individuals hired via the platform.
7.3 GuardCheck Indemnity: GuardCheck is not responsible for employment outcomes resulting from its screening reports, nor for any subsequent action taken by the client based on screening data.
8.1 GuardPass and GuardCheck do not guarantee:
- Accuracy or completeness of data sources.
- Fitness of the services for any specific purpose.
8.2 GuardPass and GuardCheck shall not be liable for:
- Direct, indirect, or consequential damages.
- Delays, data losses, or service interruptions beyond their control.
9.1 GuardPass and GuardCheck may suspend or terminate services in cases of policy violations or non-payment.
9.2 Upon termination, users must cease all use of services and delete any proprietary or confidential materials.
10.1 These Terms are governed by the laws of England and Wales.
10.2 Any disputes shall first be attempted to be resolved amicably or through mediation. Unresolved disputes shall be referred to the courts of England and Wales.
11.1 GuardPass and GuardCheck shall not be liable for service failures caused by circumstances beyond their control, including but not limited to:
- Natural disasters.
- Network failures.
- Changes in regulatory requirements.
- Government actions.
